Officers received several complaints from holidaymakers about a man they had seen behaving strangely near Praia da Luz, where the McCann family was staying.

The revelation will add weight to the theory that Madeleine was snatched to order by an international paedophile gang after being photographed by a "spotter".

In a separate twist, it has emerged that a British yachtsman told police he saw Madeleine on a Caribbean island in May.

Both developments are disclosed in newly released Portuguese police files. Last week it emerged British police were told Madeleine had been abducted three days after being photographed by a spotter.

According to the account in a Metropolitan police email sent to the Portuguese and Leicestershire forces, the picture was sent to a child abduction ring in Belgium, which had placed an order for a "young girl".

Having seen the image, the gang agreed that Madeleine should be taken. The files reveal that on May 9 last year – six days after Madeleine disappeared – officers interviewed Ernesto Mochacho, owner of a restaurant on Zavial beach, a 20-minute drive from Praia da Luz, which has a naturist area.

Mr Mochacho recalled seeing the McCanns with their three children for the last time at his restaurant in April.

His son, who also works at the restaurant, the only one on the beach, said he told police he had seen a "tall, thin Englishman in his forties" taking photographs.

"He was weird, a strange guy," Ivo Mochacho, 23, told The Sunday Telegraph. He said police visited the restaurant just after Madeleine vanished.

"Madeleine came here for lunch with her parents not long before she disappeared," he said. "I don't know if this guy took a picture of Madeleine. It's impossible to say. But he took a lot of photographs on the beach.

"The police said they had had complaints about a man acting strangely on the beaches. They thought he might have been a watcher, a voyeur. They told me to get in touch if I saw him again but I never saw him after that."

Mr Mochacho said members of the "Tapas Nine" – the group of friends dining with Kate and Gerry McCann on the night Madeleine went missing – were regulars at the restaurant, which has a terrace looking out across the Mediterranean. "They came a lot but I only saw the McCann family here once," he said.

The McCanns have long suspected that three-year-old Madeleine was abducted by a paedophile gang.

Last month police shelved their investigation and finally cleared the couple, both 40-year-old doctors from Rothley, Leicestershire, of involvement in Madeleine's disappearance.

Portuguese files also reveal Trevor Francis, a British yachtsman, told police he had seen Madeleine on the island of Margarita on May 16 this year.

Mr Francis, who is retired but owns a nursing home in Worthing, West Sussex, and captains a charter yacht, told police in a statement in June: "I saw the little blemish in her right eye. She really stood out. She was the absolute image
of the missing Madeleine."


Mr Francis said he was having lunch at a restaurant in the town of Porlamar on Margarita, which is part of Venezuela, when the girl arrived with three women who looked Spanish or South American.

He said: "I was afraid to do anything. I decided to get a good look to make sure it was her so I could report it."

The girl looked healthy, but seemed "sullen and refused to eat", he said. His report has been sent to the Portuguese and Venezuelan authorities.

Hmmm yachts man ...anyone here read merlin's???Just jumped out at me when I read that. Yet another sighting of madeleine from only a couple months ago.Whats the bet now..that more people from that area will follow in suit and also report that madeleine as been spotted by them in this same area...watch this space.

Where are the privates?????Thats what we don't know....and thats the real place of investigation.

The mark in madeleine's is eye is extremely rare which makes me wonder ...what is the chances of seeing a child of madeleine's description with this mark in the eye????

The guy on the beach taking pictures???Hmmmmmmmmm could it be a innocent tourist or something more sinister.Mehtinks he wasn't up to no good as apparently someone chased this guy at one point and got a picture of him on their mobile but it was unclear and couldnt be seen properly.

isn't there any cctv in that area of luz???Wasn't this guy caught somewhere on cctv...they reckon today you cant walk anywhere as in each day you are caught on cctv soooo many times without even realising it???It appears to be a useless task having so many cctv cameras as they aint providing any use are they?

Heres another link giving more detail on the gUy who saw her in the restaurant recently.He says he is sure it was her and went to get a closer look at her....it was then he saw her fleck in the eye.She had chin length fair hair etc etc....and he didn't want to grab her because he was afraid of causing a drama??????HELLO!!!!!!!!!!!!!!!!!!!!!!!
If it was me who saw her i would have shut the door up quietly without letting on,then made sure other customers were aware etc and in seconds those 3 women would have had the whole bloody shop on there backs.

But gee this is a long way from Belgium, and the people she was with are Spanish/Portuguese or South American.

Surely both theories cannot be right.

Maybe Madeleine was targeted by a paedophile ring but never delivered, because her face was too well known.

I find this disturbing really sick and disturbing. That wee soul.. was she taken to order and why are these people getting away with this sort of crime? Little Rue has never been found and I fear for Maddie….. :(

The report of the sighting in Zavial has something wrong. Algarve, the whole of it, does not overlook the Mediterranean but the Atlantic. Surely a reporter mistake.

And if it were you who spotted the girl in Venezuela, you wouldn't have done nothing of the kind, I assure you. Kidnappers in Latin America are no joke.

And by the way, even if it wasn't Madeleine in Venezuela, it surely was an european little girl. It is only too normal european children to reffuse latin american food as it tastes very different from ours, even considering our own differences.

My greatest hope is because of all the publicity Madeleine never actually got passed on to the "purchaser". I think the kidnappers didnt legislate for the mass publicity. Maybe it was their intention to keep Madeleine underground until the publicity died off, but all credit to Gerry & Kate they have maintained her profile.

Now 16 months on and Madeleine is still a hot potato, I wouldn't think they would keep her in one place all of the time, they would keep moving around and it wouldn't surprise me if one of these sightings is credible. I still live in hope.

Cautiously, I am beginning to feel a very small stirring of hope here that a couple of the recent sightings are of Madeleine.

Re Trevor Francis Sighting...... a couple of things made me alert to the possibility that there may be something in this. Trevor’s son said “My dad is a very serious, credible and intelligent man. He’s not the sort of person who would make things up. And he’d certainly never lie about something like this.” Also the Caribbean islands are on a regular sailing route from Portugal and I think it was Alroy, that was always most insistent that Madeleine was taken out of Praia da Luz by boat.

The other sighting that gives me some hope is, "dozens of specialist police were drafted into Brussels yesterday after a bank security guard reported he saw a girl resembling her on Monday.
Detectives studied the CCTV pictures from the KBC bank in the rundown immigrant Molenbeek district, other officers trained in search techniques joined the hunt."


A spokesman said: “We’re taking this very seriously. House-to-house searches have started, and numerous people are being spoken to. We’re determined to establish exactly who the little girl in the CCTV images is.”

This of course means that they have studied the CCTV footage and must think that there is a strong likeness to Madeleine.

Just keep hoping and praying hard that Madeleine's torment and that of her parents is about to end with their beloved daughter being returned home.
When she is home everything else can be worked on.

I just feel that Madeleine is still alive, don't know how but I do and I know that others think like me too.

A senior Brussels police source involved in the hunt for Madeleine said: "Of course we get a lot of useless sightings from crackpots but this is from a very credible person, a bank employee.

"We are looking into it thoroughly. The girl apparently looked just like Maddie and she seemed to be with this woman but slightly apart from her.

I was hoping to hear more on it too. But then no news is good news and maybe they are hushing what they have got. Im not sure about it completely though as I would like to think they would have been a bit hush about all of it. However my hopes are risen and I think that soon we could be seeing a little more positive reports..or maybe even a little someone reported found.

God madeleine let this be you sweetie.I wish i could see her..i would definitely do something for her.I could not stand by and watch her be taken away again.No way...i couldnt do that to an adult let alone a child.

I suppose we all know what we would do if we every saw a child that looked like Madeleine but we have to remember we have made it our business to know and we have thought about possible scenarios of what we could do to alert attention.
This man was just having his lunch probably the furthest thing from his mind was Madeleine McCann and suddenly he if faced with a child that could be her, he is hesitant and does not want to make a fuss etc and it probably really scared of being proved wrong, so I can go a little way into understanding what kind of dilemma he would feel. Don't forget a lot of these people are in foreign countries and do not even know how to call the police.

I have wondered what I would do if it were in this country then this would be fine, I would simply say no you are not leaving until the police arrive and they have sorted the situation out, but even then it would be difficult getting someone to stay where they did not want to be.

The best way would be to actually detain the child and risk getting attacked from her irate parents, but if the child was Madeleine I do not think the adult would be too keep on waiting around until the police arrived, I would think they would leg it at the first chance they got, no way would they want to be caught with her.

I know as it stands at the moment I would recognise Madeleine no matter what colour hair she had but as time passes I wonder if I would recognise and older Madeleine, possible talking a different language and what about if she had a suntan too, would we recognise her then?

It is all very well to say what we would do faced with this situation but I honestly think that it would be a lot harder to put into practice. I would like to think that I would recognise her beyond a shadow of a doubt, if this happened within closed space I could block the door and ask for the police to be called, but if in a foreign land, would they understand what I was saying and would they think I was a complete loony and chuck me out?

I think this is a lot harder than it appears. Maybe I would try and follow them and see where they went and then report it to the police, giving them an address?

I think if I were the sailor after noting her eye i would have quietly left the restaurant and called the police hanging about outside until they arrived, if they left then perhaps I would do something about stopping them until the police came, which I knew were coming because I had called them?

Madeleine may even have her own hair colour. It has been a long time and no one has caught up with her, so her captors may think it is safe to walk around with her, looking sort of how she looked before, probably different hair cut though. After getting away with it for so long, they may be a lot more open now. I wonder though do the reported sightings drive them underground again, or if they are mostly wrong, do the sightings encourage the captors to continue the way they have been. I still think that most sightings are not Madeleine, and the captors would know. But I do wonder if some are, perhaps the Carribean sighting, or the Belgium bank sighting are. And if the captors are still not caught, does that increase their confidence even more.

When Elizabeth Smart was missing, she was never kept locked up from public view, yet they didnt find her for nine months, I think. She was only found when she was back in her home town (or very near to there). That is how complacent that captor got.

On what I would do. I would get close enough to see if it is her, through her eye. And if it is, then I would signal to my partner to call the police. And if the people tried to leave, I would cause a huge ruccus, and try to engage the other people around to help stop the people from taking her away. I know it is dangerous, but so is what is happening to Madeleine. As long as my own children are not in danger, or other people's children, then I would risk myself. But I would have to see that eye. Otherwise, I would take notes and rego's etc, or try to get a photo on a camera, or phone, to give to the police. And I dont mind being arrested for harrassing someone, if the child turned out to be Madeleine, or even if not her.

After all, if it isnt Madeleine, or another stolen child, why would any parent worry that you have called the police etc. I know I wouldnt care, as I know I dont have her. And most normal people are only too happy to help the police when it comes to missing children. It would only be dangerous when dealing with a criminal element, but it is worth the risk.

And I look for her everywhere I go. I doubt she would be out here in the outback where i live, but really if you wanted to hide, this is as good a place as any.

I understand what you are saying Diane, I know I would never just walk on by without trying to do something. The sailor could have gone outside and called the police hanging around until they came, why didn't he do this? Why wait until he cam back to the UK? But I am encouraged by what his son says, there was no need for his son to say anything, but he did.

As for being out in the outback, who knows she is somewhere, she has to be somewhere.

I am still a tiny bit optimistic over this one though.

We are talking about Venezuela, as I said before kidnappers there are no joke. Neither are the police. I can understand quite well why a british (sailor) would not do anything involving any of these groups.

What puzzles me is why didn't he contact for instance his son back in the UK passing him the information and waited all this time.

I would still contact the police straight away, and the British Embassy. I wouldnt wait until I got home, I would do it while they were still at the restaurant. After all, maybe they pay by credit card, or if regulars, they may have an account, and by investigating that day, there ismore chance of the staff remembering them. But Maria, it needs to be said that the captors could be equally dangerous in any country, even without having organised crime links. And organised crime exists in all countries, it is just that in countries like Aust and Britain, child trafficking isnt one of the usual activities of our organised crime organisations.

And unless they were carrying machine guns on their backs, I would still try to stop them, it depends on how scared I was. But that doesnt mean I would physically intervene. After all, how could I live with myself if I let a little girl, that I knew was Madeleine to be left with people who could be hurting her. As I said though, I wouldnt put my own children, or other children in danger, so the first thing is the police. If I was scared, and that would probably be the case, then I would try to follow them to get registration details of their car, or where they went. I try not to just look the other way, I once found a little 2 yo boy out on the street by himself, when I was going for a walk. I didnt know what house he came from, but I didnt leave him, I grabbed him, and then went knocking on doors until I found his mum. She knew he was gone and was worried sick. And an elderly couple of women from across the road from where he lived, vouched for the mother. Somehow the front door had been left unlatched and it opened when he pushed on it, so he took off, and he crossed a fairly busy road, and no one else even stopped.

I am not 100% sure but I dont think the police in Venezuala are part of child trafficking, and they also dont muck around when it comes to arrest and holding people. So I would chance it, after all, if you did grab the child, and didnt attempt to take the child away, you are not guilty of kidnapping. But I stress, I wouldnt take any unnecessary risks that would hurt anyone else, including the child.

I think the best course of action for anyone that thinks they have seen Madeleine is to call the police emergency line straight away, and try to keep track of the people. No matter what country you are in. But if they were getting away, then maybe causing a ruckus might just be the thing to detain them. I dont know. I really dont.

Its a pity the guard at the Belgium bank didnt call the police straight away. If he had seen Madeleine's photo the day before instead of the day after, he would have called.

And of course, I dont really know what I would do, because I am not in the situation. I can only hope that I would act in an appropriate manner. It really is hard for people to know what to do, and they do the best they can under the circumstances.
