Rui Pedro´s case update today

Post by Pedro Silva on Sun Feb 27, 2011 7:28 am

My friends, Rui Pedro´s case, an update today:

Prosecutor moves forward with charges of kidnapping in the case of Rui Pedro.

Afonso Dias, the last person seen with Rui Pedro, was accused of the crime of kidnapping. According to the indictment of the Central Bureau of Investigation and Prosecution (DCIAP) that the DN had access, the investigation analyzed various information and clues about the whereabouts of Rui Pedro, especially abroad. However, none was consistent.
The accusation of DCIAP is based on testimonies of people who saw Rui Pedro on the day of his disappearance, presenting a reconstruction of his last movements in the company of Dias. One witness is a prostitute who claimed to have been paid by Dias for having sex with the minor on March 4, 1998. However, given the state where Rui Pedro was "very nervous" described, she decided not to consummate the act, returning the child to Afonso. From this moment, nobody ever saw the young Rui Pedro.

Read tomorrow's print edition and e-paper DN (Diário de Notícias) every detail of the accusation from the Prosecutor / DCIAP.

More updates today:

The Judicial Police said this Sunday that no new data in the case of Rui Pedro, the 11 year old boy who disappeared in 1998 in Lousada.

The coordinator of the PJ criminal investigation regretted the delay in investigation due to the change team in 2007 that only after 13 years allowed the accused of kidnap the prime suspect in the case.

However, Jose Monteiro said that time also turned out to help the investigations, to eliminate the various hypothesis mentioned.

The responsible also noted that the charge of Afonso Dias was based on the thesis of abduction of the young.

Remember that Rui Pedro disappeared on March 4, 1998 and Afonso Dias, at the time with 21 years old, was appointed by several witnesses as the last person with whom the child was seen.

The president of the College of Lawyers demanded, this Sunday, to the prosecutor's explanations about the delay to the deduction of the charge of the main suspect in the disappearance of Rui Pedro, 13 years ago. Marinho Pinto said that should be the own attorney general's office, Pinto Monteiro, to give clarification on the subject.

"I think 13 years is more then time. It was good that the prosecutor gave an explanation why it took so long to acknowledge. What are the new elements that have emerged and that led prosecutors to make accusations. If there was no new evidence, why it took so long? "questioned Marinho Pinto, told Radio Renaissance.

For the Head of the Lawyers Association, it is necessary to know what happened to the boy: "You must still see what happened to that child, because the crime which apparently is a question of abduction. You have to see what happened, whether it was dead? Whether this is a homicide? What actually happened '.

Candida Almeida, director of the Central Bureau of Investigation and Prosecution (DCIAP) acknowledged Sunday that no new evidence in the case of the disappearance of Rui Pedro, 13 years ago.

Speaking to the TSF, the deputy attorney general said that "we made a thorough investigation, " but it did not come 'new evidence ' only in-depth exploration of existing evidence.

Still, Candida Almeida praised the work of the team of attorneys from the prosecutor in charge of the prosecution, stressing that it allowed "to go to the substance. "

The director of DCIAP praised also the 'exceptional technical and human quality of the magistrate' who led the charge in recent years, stressing that until then "the tracks were open but no exploited to be closed. "

Candida Almeida regretted, however, the length (13 years) was completed to the indictment, but cautioned the persistence, noting that the judges could have simply opted to close the case for lack of evidence

The mother of Rui Pedro, the young boy who disappeared thirteen years ago in Lousada, on Saturday reacted to the decision of prosecutors to charge Dias for the kidnapping of the young boy, saying she was hoping that this step will bring us more information.

"It may be that from now on, I know what really happened to my son, " said Rui Pedro´s mother ,. To the Jornal de Notícias: "I'm looking forward to see what will happen, " said Filomena Teixeira.

"Really, 13 years is a long time, but it's often said that it is better late than never, " she said in remarks to the newspaper, confirming the notification of the PM.

Dias, the main suspect in the case of Rui Pedro, was pointed out by several witnesses as the last person to be with the young on the day of his disappearance, thirteen years ago, was on Saturday charged with the crime of kidnapping.

Cautioned the persistence noting that the judges could have simply opted to close the case for lack of evidence

This case has been left open for 13 years. Why haven't they done this in the Madeleine case?? It seems to me that they are still adament that her parents had something to do with her disappearance, and are not willing to look any further?

Hang on there is a big difference.

There were witness reports of dealings with the alleged abductor who was with Rui at the time.

There are no confirmed anythings in Madeleine's case.

That is the difference. The prostitute's statement has not been disproved, and although it by itself was probably not enough to go further, it must have been enough to keep the case open. So in other words, it was not no evidence, it was a lack of evidence.

What is there in the debacle that was the investigation into Madeleine's disappearance, that gives any indication where she is, or where she went, or who took her? In other words, there is no evidence of anything, except that Madeleine was missing from her bed.

Let´s get this straight once and for all: there is absolutely no relation between Madeleine´s case / Rui Pedro´s case.

Rui Pedro´s case update:

The court of Lousada took a lok at the place where several children have seen 13 years ago, Rui Pedro entering the vehicle suspected of being the alleged kidnapper who is in court at this location.

In this investigation, the collective, accompanied by the prosecutor (PM) and by defense lawyers and family questioned in Lousada Preparatory School, one of the witnesses who at the time went on trial studying the establishment where Rui Pedro studied
.
Daniel Costa, one of five witnesses who said in the process the he had seen Rui Pedro with the defendant on the day of the disappearance - March 8, 1998 - reaffirmed today, visiting the school, which had said earlier in the courtroom.

The witness, now 24, spoke at the place where, on the day of disappearance, saw Rui Pedro. Daniel Costa, with other colleagues, played the ball into the school grounds and there saw Rui Pedro, cycling, on land outside the fence of the school.

The witness assured the court that Rui Pedro was seen next to a black car, small on a dirt road in a place now occupied by an apartment building a few dozen meters from the fence of the school.

Like other former colleagues had said on Wednesday in a hearing, the witness said he saw Rui Pedro enter the car and the driver believed to have been Afonso Dias, the sole defendant in this process.
The current head of the school, which at the material was already teaching, the court confirmed that in that place, formerly a greenhouse, the students used to play football, although not an appropriate space for this purpose.

However, it was unclear whether the site of care was possible to observe the exact point where the bike has been found allegedly owned by Rui Pedro.

In the end, family lawyers and the defense found it useful that approach, because the court allowed a better perception of where the facts have been abundantly contained in the process.

This step, required by the Assistant, was admitted by the court because the witness will leave on Saturday to France, where he lives and works.

The beginning of the third session of this trial session was marked by the fact that the wife of the defendant, following a statement of defense, refused to testify, a right provided for family members of defendants witnesses.

The trial resumes on Friday with hearing a few more witnesses presented by the prosecution.

The defendant is only present in the morning because the afternoon will undergo an expertise in Penafiel, requested by the defense, to determine his current psychological conditions.

My friends, Rui Pedro´s case update today:

Portuguese newspapers today:

translation:

Rui Pedro: court will heard today the prostitute who has been with the missing child

The Prostitute who has been with Rui Pedro on the day of his disappearance, is considered by the defense and prosecution witnesses one of the main witnesses of this trial.

The court will hear today in Lousada the prostitute, according to the prosecution case called 'Rui Pedro', has been with the child on the day of his disappearance, more than 13 years.

The prostitute is considered by the defense and prosecution of a key witness in this trial, which sits in the accused bench Afonso Dias for a crime of qualified rape.

The thesis of the Public Ministry (MP) holds that the defendant seduced and took the child, then aged 11, for a meeting with prostitutes in Freamunde.

According to the indictment, a prostitute claimed to have been in Lustosa with the child on March 4, 2008, when Rui Pedro was last seen. The woman is told that Alfonso was with the child that led to that encounter.

The session this Monday is the fifth of this trial, which has been marked by statements from several former classmates of Rui Pedro. All them told the court they saw the child on the day of disappearance, with a black vehicle, which claims to be the MP of Afonso Dias. Some former students, now adults, have even said they saw the child into the car.

Afonso Dias strategy opts for silence

In the second session, the cousin of the missing child told the court he was invited - along with Rui Pedro - to go to prostitutes to Freamunde, confirming the thesis of the prosecution.

John Andrew Mendonca, now 25 years and had 12 at the material time, explained that the call was made outside the school, near a road, on the eve of the disappearance of Rui Pedro, ie, on March 3, 1998 , a Tuesday.

The witness revealed that Afonso Dias, whose friendship was greatly appreciated by Rui Pedro had promised to the two children go on Wednesday, firing rockets into the area of the track Costilha, after which follow by car to the prostitutes.

This trial has also been marked by the accused's silence and refusal to give evidence of his wife and a brother, listed as witnesses by the prosecution.

The defense takes the silence of Afonso Dias is a strategy and that the defendant will only talk at the end of the hearing of evidence is "considered appropriate for ascertaining the truth."

Prostitute says that “arguido” took Rui Pedro to her on the day of the disappearance

Alcina Dias identified in court, the defendant Afonso Dias as the man who led Rui Pedro to the place where the boy would have been last seen in March 1998, before disappearing.

The prostitute confirmed in court that Rui Pedro was presented to have a sexual experience on the day he disappeared in 1998.

During the court, she said that Rui Pedro was taken to the place where she prostituted, by a man. The defense attorney, Ricardo Sá Fernandes, asked the witness if the man who took the boy was in court. Alcina Days turned back and pointed to Afonso Dias, the accused / arguido, reported RTPi.

The woman says she was approached by Afonso Dias, who was inside a car with Rui Pedro, and that she received money to have sex with the child. According to the prostitute, the boy was nervous and started crying, so she gave it back to Afonso Dias, who saw him taking off, with the young, driving in the direction of Lousada

Alcina Dias also said to the Court of Lousada that Rui Pedro had told her that the man who accompanied him was called Afonso, reported TVI24.

The defense of the defendant points out some contradictions of the witness, including the fact that the prostitute never identified Afonso Dias at earlier stages of the process, seeking to discredit the testimony of Alcina Days.

Prostitute says Afonso took Rui Pedro
Woman says Alfonso paid him to have sex with the child, but the boy began to cry. She also said that Rui Pedro told the man's name

Alcina Dias, the prostitute who has been with Rui Pedro on the day of disappearance, in court confirmed the version that had already counted in the investigation stage and in an interview with TVI.

The woman says she was approached by Afonso Dias, who was inside a car with Rui Pedro, and that she received money to have sex with the child. But as the boy was nervous and began to cry, she returned it to Afonso Dias.

Alcina Dias also said that the Court of Lousada that Rui Pedro had told her that the man who accompanied him was called Afonso. She herself recognized the accused present in the courtroom as the adult who was with the boy that day.

The witness, however, presents some contradictions in his version, as it had done in the investigation stage. It said the boy's eyes were blue [and not] and that the child was low, appearing to have five years.

The prostitute is considered by the defense and prosecution of a key witness in this trial, which sits in the accused bench Afonso Dias for a crime of qualified rape.
