Kate and Gerry McCann – clarification on the news published based on Wikileaks’ referrals

Gerry and Kate McCann sent a statement to the Portuguese media after Wikileaks published “news” last week about the investigation. Below is the statement:

“The speculations that have been published about our daughter’s disappearance as referred to on WikiLeaks forces us to take the following position:

WikiLeaks website has published a summary of an alleged telegram exchanged between USA and UK Ambassadors. This summary does not contain any new or relevant facts that will lead us to the discovery of what happened to our daughter.
If the mentioned telegram does exist, its content only tells that the British Police developed in September 2007 (we believe that to be the date of the correspondence exchange) information regarding our responsibility in the disappearance of our daughter.
We recall that on that date the team coordinated by Gonçalo Amaral was still investigating the case, having produced a report incriminating both of us. That report was not supported by evidences that validated his allegations so due to the absence of any incriminating evidence about us, the case was filed after eight months of further investigation.
Presumably, if any correspondence summarized by WikiLeaks does exist, it is based on the circumstances that arose in the investigation at that time since we do not know that there has been any further investigation besides the one that we all know about – and in the process there isn’t any information to the contrary.
Once again, the ex-inspector Gonçalo Amaral has seized the opening given by the Portuguese media for his thesis, producing deeply hurtful insinuations and citing the investigations’ defects. Defects in the investigation that he coordinated and which didn’t achieve any useful results for our daughter.
These speculations are periodically brought to public opinion by that former employee of the PJ, accompanied by threats to reopen the case on his own initiative.
When he claims publicly that he knows what is still to be done on the investigation and if “what is still to be done” is the investigation of facts, documents, data or real and concrete information that lead to Madeleine’s whereabouts, discovery or even the reason for her disappearance, he has the obligation to present it for the procedure to reopen the investigation, in which we are most interested.
We are aware that Madeleine’s disappearance is an inexhaustible source of enrichment to Gonçalo Amaral by means of false accusations, deeply offensive and harmful to the investigation itself, so we appeal to journalists’ critical sense to sort out what is journalistic information and what is speculation, surgically oriented, to obtain easy profits.

Depois das “notícias” divulgadas pelo WikiLeaks, acerca da investigação, a semana passada, Gerry e Kate McCann enviaram uma declaração à imprensa, que reproduzimos de seguida:

“As especulações que têm vindo a ser publicadas sobre a referência à publicação da WikiLeaks relativa ao caso do desaparecimento da nossa filha Madeleine, obrigam-nos a tomar a seguinte posição:

O site da WikiLeaks publicou um resumo de um suposto telegrama trocado entre os Embaixadores dos EUA e Reino Unido. Esse resumo não contém factos novos, com interesse para a descoberta do que aconteceu com a nossa filha.
Caso o mencionado telegrama exista, diz-nos apenas o conteúdo do seu resumo que a Polícia Britânica desenvolveu, em Setembro de 2007 – que julgamos ser a data da troca daquela correspondência – informações sobre a nossa responsabilidade no desaparecimento da nossa filha.
Recordamos que àquela data, a equipa coordenada por Gonçalo Amaral mantinha-se em funções na investigação do caso, tendo produzido um relatório incriminador para nós os dois, relatório esse que não resistiu à sua própria insustentabilidade e à inexistência no processo de quaisquer indícios que permitissem incriminar-nos, pelo que, após mais 8 meses de investigação, o caso foi arquivado.
Presumimos assim que a existir a correspondência resumida pelo WikiLeaks ela se baseie nas circunstâncias que ocorriam na investigação naquele período, uma vez que desconhecemos pessoalmente e não existem no processo dados contrários, que tenha havido quaisquer investigações complementares àquelas que são conhecidas de todos.
O ex-inspector Gonçalo Amaral, mais uma vez, tem vindo a aproveitar a abertura dada pela comunicação social portuguesa às suas teses, produzindo insinuações profundamente danosas em que aproveita para invocar defeitos da investigação que ele próprio coordenou e da qual não foram obtidos quaisquer resultados úteis para a nossa filha.
Estas especulações são periodicamente trazidas à opinião pública por aquele ex-funcionário da PJ, acompanhadas por ameaças vazias de reabertura do processo por iniciativa própria.
Uma vez que o referido senhor declara publicamente que sabe o que ficou por fazer naquela investigação e se «o que ficou por fazer» for a investigação de factos, documentos, dados ou informações reais e concretos que levem à descoberta do paradeiro de Madeleine ou mesmo das razões do seu desaparecimento, tem o referido senhor a obrigação de as apresentar no processo com vista à reabertura da investigação, de que nós somos os maiores interessados.
Temos consciência de que o desaparecimento de Madeleine é para Gonçalo Amaral uma fonte inesgotável de enriquecimento por via de imputações falsas, profundamente ofensivas e prejudiciais à própria investigação, apelamos ao sentido crítico dos jornalistas para destrinçarem a informação jornalística daquilo que são especulações e meios duvidosos de lucro fácil.

Inconclusive Information: Food for Opinion or Conclusive Evidence?

When an investigation into a missing child progresses, one would expect that investigation to be thorough and processed with integrity and honour. Madeleine McCann deserves no less; the gathering of evidence being crucial to propagating a line of investigation. In my opinion it is right that all possibilities are investigated and evidence considered by it’s conclusiveness and strength.

In the case of missing Madeleine, the investigation was shelved as a result of lack of evidence to determine a crime or suspect(s). Sadly, as has been revealed by the publication of the case files and the more recent WikiLeaks, the case has been exposed to have been following a line of investigation,to the detriment of the possibility that Madeleine was abducted. In fact the abduction theory was completely overlooked and information that had been sent in possibly ignored. One would expect the law enforcement to have conclusive evidence to give up looking for Madeleine and an abductor. Yet the case publicity shows otherwise.

It is common knowledge that the British police were cooperating with the PJ and helping them gather information to examine evidence to consider as proof, or to eliminate certain processes. The pivotal point of the investigation was the alert dogs information with the crucial results of their forensic interpretation from the FSS laboratory: pivotal in the sense that the results were proved as inconclusive. On closer and more learned examination the results could not conclude anything, positive or negative. What this means is that, in layman’s terms, the results were no more than a flip of a coin. The results showed that the British alert dogs told the detectives that death and concealment was a line of investigation now redundant and without positive proof necessary to continue on that path.

It was at this very pivotal point that the inconclusive evidence resulted in the British police backing off from suspecting the McCanns.

This is the most valid and profound reason why the case needs to be reviewed. All information re- visited to investigate if anything was overlooked because those responsible for the investigation carried on regardless, believing inconclusive evidence is positive proof.

The only weight that ‘inconclusive’ can provide, is to invite opposing opinion. Opinion is not fact or proof.



Quando a investigação sobre uma criança desaparecida progride, é de esperar que seja profunda e conduzida com integridade e honra. A Madeleine McCann não merece menos do que isso; a obtenção de provas é crucial para o desenvolvimento de uma linha de investigação. Na minha opinião, é correcto que todas as possibilidades sejam investigadas e as provas consideradas pela sua argumentação e força.
No caso da desaparecida Madeleine, a investigação foi arquivada devido à falta de provas para determinar um crime ou suspeito (s). Infelizmente, como foi revelado com a publicação do processo e, mais recentemente, pelo WikiLeaks, o caso seguiu uma linha de investigação que não considerava a hipótese de a Madeleine ter sido raptada. De facto, a tese de rapto foi completamente ignorada e todas as informações enviadas neste sentido foram ignoradas. Seria, por isso, de esperar que existissem provas conclusivas que levassem à desistência de procurar pela Madeleine e o seu raptor. No entanto, a divulgação do processo mostra o contrário.

É de conhecimento geral que a polícia britânica estava a cooperar com a PJ, ajudando-os a reunir informações e a examinar indícios a considerar como prova, ou a eliminá-los do processo. O ponto central da investigação foi a informação dada pelos cães, com os resultados cruciais da sua interpretação forense, pelo laboratório FSS: ponto central no sentido em que os resultados foram considerados inconclusivos. A mais detalhada análise dos resultados não concluiu nada, nem de positivo, nem negativo. O que isto significa é que, em termos leigos, os resultados não eram mais do que um lançamento de uma moeda. Os resultados mostraram que os cães britânicos demonstraram aos detectives que a morte e ocultação eram uma linha de investigação redundante e sem provas necessárias para continuar.

Foi este o ponto crucial – as provas inconclusivas – que levou a polícia britânica a deixar de suspeitar do casal McCann.

Esta é a razão mais válida e profunda para que o caso seja revisto. Rever todas as informações para verificar se algo foi “esquecido” porque os responsáveis pela investigação mantiveram a linha de investigação, considerando indícios inconclusivos como provas.

Ser “inconclusivo” só abre caminho para opiniões contrárias. Opinião não é um facto, nem uma prova.

It's actually not even a telegram between the US and UK ambassadors. It's a daily cable that every US embassy sends to the State Department (our Foreign Ministry) to tell them what was going on that day in that country. As you can imagine, since some days are busier than others these cables run the gauntlet from very important to very boring. This one relayed a conversation the US ambassador to Portugal had with Ellis, the UK ambassador to Portugal. It's a paraphrase of whatever Ellis said, not even a direct quote. And really, what he said was so simplistic, so obvious - it's disgusting the way Morais and others have used that lying, made-up El Pais article to create a mountain out of molehill. The McCanns had just been made arguidos. It was the biggest case in Portugal at the time. Of course the ambassadors were talking about it. And the "key" to the arguido status was the meaningless dog alerts and the meaningless and inclusive forensics - both of which had been suggested and worked on by British teams (ie, "developed).
