What is this difference between a "review" and a "reopening"? I thought there was a huge difference.

There is a huge difference Rosemary the opening of the case will just lead to more of the same and the case will eventually close again, the PJ will site "lack of leads and evidence" etc, also as it is now a cold case, it would require specialist cold case detectives to work it. Does Portugal have any? They barely have any detectives capable of working a case when it is red hot, if they are all like Goncalo Amaral!
A review takes in ALL information from ALL agencies, this means the PJ investigation, the British investigation, the McCanns Detectives, Metodo3, everything and everyone and they pool all this info, when this has been done in other cases, it is not uncommon for new leads to emerge as a result, suddenly something very insignificant comes to be extremely significant when it is put alongside other evidence.
Like the "CCTV Camera" that Amaral has suddenly decided is important, pity he did not think this at the time he was running the investigation.
So a review is much more powerful than just the PJ doing another investigation and getting nowhere, a review would require a team of cold case detectives also.
If Madeleine is to be found, this is what is needed!

Without an official review concerning both Portugal and the UK, this case is going nowhere.

***IMPORTANT***

If we can get 100.000 signatures on this petition, then it MUST be given parliamentary time in the House of Commons where it can be openly debated, this is little known but it is fact, so let's try and make this happen!

Up for it?

This is SUCH an important distinction, we must make absolutely sure we refer to the Review and NOT the Reopening wherever and whenever we can. Is it worth considering a new thread entitled "The Review NOT the Reopening!!" ? Any other ideas on how to emphasise what is really needed here?

Couple wants to reach 100,000 signatures

McCann circulated petition to reopen the case Maddie
10/11/2010 - 17:48 By Jennifer Lopez

Kate and Gerry McCann are circulating a petition which they intend to take the English and Portuguese governments to review the case Maddie. So far we have managed 31 000 signatures and intend to reach 100 000.

http://www.ipetitions.com/petition/madeleinemccann_case_review/signatures.

Maddie's parents say that if the courts do not reopen the process, they continue to investigate for their means (Darren Staples / Reuters)

The McCanns believe that the gathering of information that is held by the British and Portuguese authorities will find out what happened to Maddie, their daughter, missing for three and half years. With the petition, which is also available online and on paper, Kate and Gerry hope to continue the investigations and that the information held by public authorities, are available.

"If we had no help from the authorities, we must continue to look for ourselves," said Kate, in a press conference that the McCanns gave this afternoon in Lisbon. "It's like being in a race and do not know when it ends," said Gerry, ensuring that they will not give up until they know what happened to Maddie.

In relation to the bottom to find Maddie, the McCanns ensure that there is ending and that the maximum has been done to get support. "Every month we have meetings to discuss ways to ensure money," said Gerry.

About the decision of the Court of Appeal set aside the prohibition of sale of the book of Gonçalo Amaral - "True Lies" - the little McCann remained silent. According to Gerry, the book suggests that Maddie is dead, when there is evidence pointing in that direction. " Isabel Duarte, a lawyer for the McCanns, said: "The appeal to the Supreme [Court] was delivered on the 5th of November" and that if the decision of the Court of Appeal be retained, the solution will appeal to international courts.

LIVERPOOL ECHO NEWSPAPER

Paddy Shennan: High time for review of the Madeleine McCann case

IT’S not much to ask – either of the authorities or, initially, of us as individuals.
The family of Madeleine McCann, who has now been missing for three and a half years and who has been badly let down by a shocking excuse for a police investigation, is making a very straightforward request.
A request it really shouldn’t have to be making.
If you go to www.findmadeleine.com you will find a link to another website (www.ipetitions.com/petition/madeleinemccann_case_review/) which carries the following words . . .
“We call on the UK and Portuguese authorities to conduct an independent and transparent review of all information in relation to the disappearance of Madeleine McCann.”
The reader is asked to back this statement by signing the online petition, which was launched last Wednesday and, by yesterday, had received around 30,000 signatures.
That Madeleine’s parents, Kate and Gerry, even had to contemplate taking such action is a sad indictment of what has – and, more importantly, hasn’t – happened, both here and in Portgual.
They have spoken often of leaving no stone unturned in their own attempts to find their daughter – it’s just a terrible pity that the powers-that-be have not had the same attitude, nor displayed the same determination.

The family’s own investigation team is continuing to review all the available information, but it still doesn’t have access to all of the information that the UK and Portuguese authorities have.
There is a simple remedy to this – either present ALL the information to the McCanns or, better still, the authorities should do the jobs they have been trained to do and should be expected to do.
Shockingly, says Gerry McCann, “for the last two years and three months, no police force has proactively been doing anything to help us find Madeleine.”
And, he adds: “Crucially, there has been no formal review of the material held by the police authorities.”
We can only hope that common sense and common decency now prevail and the family gets the review that it deserves – having so quickly garnered the support from the public it deserves.
The message to the authorities couldn’t be clearer – don’t allow any more time to pass.

The petition on the media

Post by maria on Thu Nov 11, 2010 7:24 pm

Today, on SIC morning news, there was an extract of what appears has being a press interview given by Kate and Gerry after their meeting with their lawyer(s).

The following are my own words, for the moment I can't find a 'static' record from where I can copy/translate or an address to point you to.

They clearly referred that they are asking for a REVISION of the case adding to everything that is already in the files new pieces of evidence that came up after the process was shelved. They expressely said that they understand that this is NOT common in Portugal, where processes CAN be REOPEN only IF there is strong new evidence. They understand this is not the case, so they ask for the revision.

Nothing was said, as far as I could understand, about the dilligencies that will be taken to achieve this revision. The petition was mentioned again.

I know this is a very short very loose piece of news, but I thought I should leave it here, even because there are already other pieces quoted here that are incorrect (when reporting the revision vs reopen
approach).

Well, all mI can say is YESSS!!!!!!!!!!!!!

Couple McCann' petition already counts 31 thousand signatures

Gerry and Kate McCann want to reopen the case so that the Portuguese authorities can continue looking for Madeleine. The couple was in Lisbon yesterday and made a balance of the case

What does still move the McCann? "Find Madeleine. We will not give up on her," Gerry McCann said yesterday at a press conference that he and his wife gave in Lisbon, Portugal at the office of their representing lawyer, Isabel Duarte. Purpose of the visit: to spread the current petition, which calls for a joint review of the case between the British and Portuguese authorities. The idea is to "reopen the case," that is now closed.

"We already have 31 000 signatures, but we had some problems on the site. We want more and we want to thank all those that are endorsing the petition."

It is the latest initiative of the couple. But not the last in the literal sense. "No parent in a similar situation says 'stop now'. It would be physically and emotionally impossible," said Kate McCann, holding hands with Gerry.

Madeleine disappeared on May 3, 2007, ie two and half years. It was two and a half years of efforts paid by the couple through the Find Madeleine Fund. In the British press it has come up the news that the fund was almost depleted. Gerry McCann ensures no. "We want to emphasize that the Find Madeleine Fund is not at risk, unlike the stories that were published in Britain. Donations continue to appear. Right now we have 200 thousand pounds in the background." They still have a small team of researchers working on the case.

It is also not over the legal fight with former coordinator of the Judicial Police in the investigation, Gonçalo Amaral, because the book he wrote about the case. "The Portuguese legal system is very complex. This was the fifth time that there was a decision on the injunction [the last decision of Appeal overturned the ban on the sale of the book]. For us it is an ongoing process," he said. (See box).

A shadow hangs over Madeleine's family. "The twins ask every day about their sister, wondering when she will be back," says Gerry. Kate said that "the anniversary of Madeleine is always remembered."

A very serious accusation

Post by Pedro Silva on Thu Nov 11, 2010 11:24 pm

A very serious accusation

My friends, I received this through google alert:

http://sol.sapo.pt/inicio/Sociedade/Interior.aspx?content_id=4072

Portugal:
Gonçalo Amaral's accuses the McCanns laywer of disobedience

The Court of Appeal lifted on 19 October, the ban on the sale of the book of Gonçalo Amaral's True Lies. But Isabel Duarte, the McCann lawyer and trustee learned of the copies not yet delivered the nearly ten thousand copies to the publisher.
There are about ten thousand copies of the book of Gonçalo Amaral, True Lies, which remain in the custody of the attorney of Kate and Gerry McCann, although the Court of Appeal annulled the decision to ban their sale and distribution.
"It is strange that a candidate attorney at the Superior Council of the Bar Association has this kind of behavior, not upholding a decision of a court," commented the old SUN to Inspector of Judicial Police, indignant at not having received the books.
Amaral "don´t want to believe" in the event that the books have been destroyed, although this would be 'the desire of the McCanns'.
According to the Correio da Manha, Isabel Duarte delivered an appeal to the Supreme Court, at the end of last week, arguing that the decision of the Relationship 'did not take into account facts that, throughout the process, were never placed in question.
The lawyer believes that "the relationship did not consider that the book was made to make money, to deepen the pain of the McCanns and to jeopardize the investigation."
Isabel Duarte, while the case is under appeal, there is no obligation to deliver the material seized.
Gonçalo Amaral has another opinion: "The delivery of the books can constitute a crime of civil disobedience.
The former leader of the investigating the disappearance of Madeleine McCann argues that the decision of Appeal has no recourse. "The decision to admit only for an extraordinary appeal to the Supreme Court, ie, a resource for uniformity of case law, case law existed against the decision of the Court of Appeal." Even in this case, the appeal "would not have suspensive effect."

Amaral is very good at accusing, isn't he? And at threatning. So now we have a new target: Isabel Duarte, the candidate at the Lawyers Bar! What is it to you, Amaral? You'r not even a lawyer - yet? She's a little big woman, oh yes she is!

Congratulations, Dra. Isabel Duarte. I bow before your courage.
clapping foryou
