A killing without a corpse, since all traces had been gobbled up in the farmyard.

Yesterday, thought, nine years after Rudi Rupp disappeared, a Bavarian court opened a retrial of his supposed killers after the discovery of his intact body in the River Danube. The case has sent shockwaves through the German judicial system, which since the Second World War has prided itself on its probity and professionalism.

Mr Rupp, a 52-year-old Bavarian pig farmer, allegedly returned home from the pub one autumn night in 2001 and was hit over the head with a large wooden beam by Mathias Eisenhofer, 17, the lover of Mr Rupp's daughter Manuela, 16. He was beaten almost to death and taken to the cellar where Manuela noticed that her father's leg was still twitching. Eisenhofer then hit the farmer's skull with a sharp-edged hammer. Manuela joined in. Another daughter, Andrea, 15, watched, as did the farmer's wife Hermine.

Questioned by police, Eisenhofer said that he had chopped up the farmer with a butcher's knife, a saw and an axe. Bone and flesh were fed to the dogs - five Dobermanns, an alsatian and a pitbull terrier - and to the pigs. Conviction was made solely on the basis of the graphic confessions given to the police by Eisenhofer and the rest of the family, even though they had been withdrawn shortly before the outset of the trial.

No blood or DNA traces were found at the scene. The judge ruled that there were perfectly adequate explanations: the dismemberment took place on a plastic sheet which was later disposed of; some of the body remains decomposed on the dung heap.

"And the court will be aware that pigs are omnivores that will have eaten up every remaining morsel of body organs and bone," said Georg Sitka, the presiding judge, in his summing-up in 2005. The farmer's head, he surmised, must have been boiled before being given to the dogs. His E-Class Mercedes was almost certainly sold to a dubious scrap dealer. Motive for the killing was said to be a long history of Mr Rupp sexually abusing his two daughters.

Eisenhofer and Hermine Rupp were jailed for eight and a half years for manslaughter, Manuela for three and a half years, and Andrea was given two-and-a-half years' youth detention.

Then, last year, dredgers in the River Danube found the corpse of Mr Rupp at the wheel of his Mercedes. There were no signs of damage to his skull, the skeleton was intact and the car clearly had not been sold to a scrap merchant. The pigs, the Dobermanns and perhaps even the Rupp family were in the clear.

However, a court spokesman said: "The finding of the corpse may change the explanation of how the farmer died but does not affect the verdict." A higher court later ordered the retrial.

"The discovery of the corpse and its condition clearly show that the earlier verdict is completely wrong," said Regina Rick, a Munich lawyer representing Manuela Rupp. The family had initially denied any connection with the death of the farmer.

"It was only after months in prison that the accused gave very detailed accounts of the killing and the alleged feeding to the animals. In the end though, three out of the four accused gave almost identical explanations," she added.

"The only conceivable explanation is that the interrogating officials passed on details of the 'crime' from one suspect to another," said Ms Rick.

The defence will argue that the farmer, an alcoholic, committed suicide, and that the low intelligence of the suspects was exploited by police and prosecutor.
