Book Ban Overturned?

Post by Mulleena on Tue Oct 19, 2010 11:08 pm

Quote:
The Court of Appeal of Évora overturned the injunction filed by the McCann couple against the book written by the former PJ coordinator Gonçalo Amaral, the Court ordered the immediate replacement of the book at the usual sale points.

Quote taken form Morose,s blog, is there any truth in this?

So it seems, I've watched it right now during the news at SIC. Although the video of Amaral coming out of the court seemed so very 'plastic', no supporters, no lawyer, no press interviews... Nobody.

Watched also on RTP1. It seems it was the court of appeal of Lisbon, Cabrita gave a brief interview, and it seems that not only the book will be back on sale but also he will be allowed to 'sell' rights for new videos, films, the lot. And of course interviews will pop up like mushrooms.

I´m not happy with this court decision:

My friends, about GA´s book / video: Court authorizes sales of book: "the truth of lie" with interviews of GA abroad also.

Portuguese newspapers today:
Correio da Manhã:

Maddie: Court allows publication of the book of Gonçalo Amaral
The book 'Maddie - The Truth Lies' and the video with the same title, written by Goncalo Amaral, who headed the investigation into the disappearance of British girl, will be able to be re-marketed.

This move comes after the Court of Appeal of Lisbon has given the appeal lodged by the former coordinator of the Judicial Police, after an injunction imposed by the parents of Madeleine McCann in September 2009, at that time prohibited the marketing of the book and video.

With this decision, Gonçalo Amaral, who advocates the theory of participation of Gerry and Kate in their daughter's disappearance in May 2007 in Praia da Luz, Algarve, will also be able to give interviews in Portugal and abroad.

Gonçalo Amaral's book can return to newsstands

The Court of Appeal of Lisbon has given reason to former Inspector of Judicial Police, Gonçalo Amaral, the injunction that had been filed by the parents of Madeleine McCann.
The judges-judges revoked by order of Thursday last week, the ban had been imposed by civil courts of Lisbon, distribution and sale of the book Maddie - The Truth Lies, as well as interviews and television reports about the same in Portugal and abroad.

The McCanns claimed that the book of Gonçalo Amaral, and who had been giving interviews about it, cause "very serious and difficult to repair" in his family, particularly children, twins Sean and Amelie. Invoked, namely the injury of private life and family and the injury of his good name and image rights.

For the Value of Lisbon, however, "the book's content does not offend any of the fundamental rights of claimants. The exercise of your writing and publication is contained in the constitutional rights guaranteed to all by the European Convention on Human Rights and the Constitution of the Republic of Portugal "(relating to freedom of expression and information and freedom of the press and the media).

It is recalled that the investigation into the disappearance of Maddie was coordinated by Gonçalo Amaral and ended with a filing, without determining with certainty what happened to the child of three years. In the book Maddie - The Truth Lies, the former inspector claims that Maddie died in the apartment where her parents vacationed in Praia da Luz, probably following a domestic accident, on May 3, 2007 - after which the couple MacCann with the help of friends who vacationed with them, hiding their corpse. And claims that he was forced to write the book to defend his good name and restore his professional honor, since at one point was removed from the investigation, before it is terminated by a decision from the national Judiciary.

Judges, justices of the Court of Appeal of Lisbon compared the book and the order of closing of the investigation into the disappearance of Maddie: "Not found in the book to refer to any facts not included in that order. Where the author (Goncalo Amaral) differs from the attorneys who drafted the order is the logical interpretation, and investigative police, who comes to making those facts. In this respect, we are in presence of the right of opinion, moreover, an area in which the author is expert or not he had been a criminal investigator for 26 years. "

'The private life of the applicants (the McCanns) are that multiply themselves in interviews and speeches in the media, providing them with information that otherwise would hardly be advertised "and that" voluntarily decided to limit the their right to private life, to achieve higher values as the discovery of the whereabouts of her daughter. "

But in doing so, 'opened the doors for others to express their views on the subject, in line with what they said, but also possibly in contradiction with its guidelines, but always within a legitimate and constitutionally guaranteed right to review and freedom of expression of thought. "

Judgement was given by the judges-judges Francisco Bruto da Costa, Catarina Arelo Mando and Antonio Valente.

Gonçalo Amaral's book on Maddie can return to newsstands.

Gonçalo Amaral's book on the case of Madeleine McCann could return to newsstands. The Court of Appeal of Lisbon just to agree with former coordinator of the Judicial Police, who always defended the thesis of the death of English girl.

"The book's content does not offend any of the applicants' fundamental rights" and "the exercise of its writing and publication is contained in the constitutional rights guaranteed to all by the European Convention on Human Rights and the Constitution of the Portuguese Republic," reads in ruling that JN had access.

In September 2009, after an injunction filed by the McCanns, the Lisbon Civil Court banned the sale of the book "True Lies" and still playing a documentary based on the work and issued by TVI. Decision that deserves harsh criticism of judges of appeal. Prohibiting the former coordinator of the PJ "to express your opinion, in any form (written, interview, analysis, comment) on what you wrote in that book, it restricts a constitutional and universal rights: the freedom of opinion and expression , "the ruling.

The three judges who signed the ruling judges consider also that the verdict of the Civil Court of Lisbon had violated the Constitution of the Portuguese Republic and the European Convention on Human Rights.

Aside from watching "True Lies" to return to newsstands, Gonçalo Amaral is thus restored the right to freedom of expression.

The prosecutor filed the case as well, which could be reopened if new evidence considered consistent about the disappearance of the child.

Gonçalo Amaral's book on Maddie case can return to newsstands

The Court of Appeal of Lisbon (TRL) found that 'the contents of the book "" True Lies "that the former inspector of the PJ, Gonçalo Amaral, has written about the Madeleine McCann case' does not offend any of the fundamental rights of parents the child, so its publication is again allowed.

In the ruling of the TRL, released this Tuesday and plays through the online edition of the Journal News, reads that the exercise of writing and publication of the book 'is contained in the constitutional rights guaranteed to all by the European Convention on Human Rights and by the Portuguese Constitution. "

It is therefore void, the injunction filed in September 2009 by the McCanns, which resulted in banning the sale of the book "True Lies."

journalist: GA can talk in public about the Maddie case and continue to sell his book "the truth of lie". The Relation´s Court of Lisbon (TRL) revoked the injunction requested by the couple McCann with the purpose of shutting up the former pj. One year ago, GA was forbidden of selling books and videos, of executing new editions and giving interviews about the disappearance of the British girl.

For António Cabrita, lawyer of the former pj, it has been restored justice at the measure against the previous decision which put in cause the freedom of thinking and expression, I recall that GA defends in the book the thesis of the involvement of Kate and Gerry McCann in their daughter´s disappearance in May of 2007.

Cabrita: it means that from this moment on, GA is free of talking about all aspects of the McCann case, it means that the TRL considered that there is no, neither at the book nor the video, from GA, any offence to the honour and dignity and good name of the couple McCann, and considered that GA was not more then his right, reinforced by 25 years of experience of criminal investigation.

Madeleine: Gonçalo Amaral considers "strengthening democracy" Value decision to rescind ban on book

The former Inspector of Judicial Police (PJ) Gonçalo Amaral considered today that the decision of the Court of Appeal quashed a ban on the sale of the book "Maddie - The Truth Lies" means "to strengthen the Portuguese democracy." Gonçalo Amaral welcomed by "no democracy at all" and confessed to the Lusa news agency that he hoped the judges of Appeal reversed the decision of the Civil Court of Lisbon to prohibit the sale of the book after an injunction filed by the parents of Madeleine McCann.

"The book is an exercise of citizenship and freedom of expression. With this decision of the Appeal, was the Portuguese who won democracy, as the ban on the sale of the book was unconstitutional, "said Gonçalo Amaral Lusa.

The former PJ inspector still ranked as "very important" decision of Appeal for the two cases brought by parents of missing British girl in 2007 in the Algarve, although no date set for commencement of trial.

In civil proceedings, Kate and Gerry McCann claim 1.2 million for defamation, while in another case Gonçalo Amaral is accused of breach of secrecy.

The decision to cancel the prohibition of sale of the book "Maddie - The Truth Lies" and the video with the same title, based on a documentary aired on TVI, was today reported by the Lusa news agency judicial source.

With the decision, the book and video can be marketed and re-Gonçalo Amaral, who defends the book's thesis involvement of Kate and Gerry McCann in the disappearance of her daughter in May 2007, a tourist apartment in the Algarve, you can return to speak publicly in the case.

The decision to ban the sale of the book and the video had been decreed on January 14 by Judge Cunha Rodrigues of July. Th the Lisbon Civil Court, which upheld the injunction filed by the McCanns.

The ban was provisionally decreed September 9, 2009, and the main suit, the McCann family claimed the protection of rights, freedoms and guarantees.

Madeleine McCann disappeared on May 3, 2007, in an apartment in a resort of Praia da Luz, where he was vacationing with her parents and two brothers.

As coordinator of the Criminal Investigation Department of the PJ in Portimão, Gonçalo Amaral joined the team of researchers tried to find out what happened to the English girl.

Kate and Gerry McCann, who always maintained the position that Madeleine was abducted, were made defendants in September 2007 but were eventually acquitted in July 2008 for lack of evidence to support the hypothesis advanced by the investigation of accidental death of the girl.

The prosecutor dropped the case, which could be reopened if new evidence considered consistent about the disappearance of the child.

A Portuguese court today overturned a ban on the sale of the book on the Madeleine case by former investigator responsible for its investigation, Gonçalo Amaral, who relates the British child's parents to their hypothetical death.
A lawyer for the parents of Madeleine McCann, Elizabeth Duarte, with Efe confirmed the decision, contrary to the claims of their clients, which was issued today by the Court of Appeal (Board) from Lisbon after an appeal of the author.
The girl's mother, Kate McCann, called the court ruling "unbelievable," said the lawyer Mrs. Isabel Duarte, who is studying possible measures to be adopted.
Madeleine disappeared on May 3, 2007 in southern Portugal and their parents have organized a worldwide campaign to find her, although Amaral suggests in his book, published one year later, the girl may have died accidentally and the corpse was hidden by the McCanns.
The work, "Maddie, the Truth Lies", was suspended on a precautionary basis in September 9, 2009 and the prohibition of sale in Portugal and other countries was confirmed on 18 February this year when the Civil Court of Lisbon has given reason the complaint of defamation and damages done by parents.
With the appeal filed by former investigator considered today by the Court of Appeal upheld, the book can be re-marketed the same way as other publications related to content such as DVD produced by a Portuguese television channel in collaboration with the author .
Amaral is also released from the ban to give lectures or speak publicly about his work. The former investigator, who retired because of the episode, could not prove the involvement of parents in the girl's disappearance. On July 21, 2008, the Portuguese Attorney General closed the case and absolved the McCanns.

Portugal: Court overturns injunction parents of Maddie

Update - The Court of Appeal of Evora on Tuesday annulled the injunction filed by the parents of Madeleine McCann against the book written by the former coordinator of the Judicial Police (PJ) Portuguese, Goncalo Amaral. The injunction had been decided by the Civil Court of Lisbon in response to a request filed by counsel on behalf of Isabel Duarte five members of the clan McCann, it includes the missing Maddie.
The court ruling prohibited the marketing of the book "Maddie: The Investigation prohibited" - in Portuguese "Maddie: A Verdade da Mentira" - and the release of a documentary with the same title that was originally released by the chain TVI television and marketed with the daily Correio da Manhã.
According to a relative of Gonçalo Amaral, former coordinator, who denies the involvement of Kate and Gerry McCann in the disappearance of their daughter in May 2007, received the news "with satisfaction and relief that justice has been done. "

My friends, taken from PFA2: Portuguese newspaper Sol:

translation:
Annul the ban is "a reinforcement of democracy "

The former Inspector of Judicial Police (PJ) Gonçalo Amaral considered today that the decision of the Court of Appeal quashed a ban on the sale of the book 'Maddie - The Truth Lies' means' the enhancement of Portuguese democracy. "
Gonçalo Amaral welcomed by 'no democracy at all "and confessed that he hoped the judges of Appeal reversed the decision of the Lisbon Civil Court to prohibit the sale of the book, after an injunction filed by the parents of Madeleine McCann.

"The book is an exercise of citizenship and freedom of expression. With this decision of the Appeal, was the Portuguese who won democracy, as the ban on the sale of the book was unconstitutional, "said Goncalo Amaral.

The former PJ inspector still classified as 'very important' the decision of the ratio for the two cases brought by parents of missing British girl in 2007 in the Algarve, although no date set for commencement of trial.

In civil proceedings, Kate and Gerry McCann claim 1.2 million for defamation, while in another case Gonçalo Amaral is accused of breach of secrecy.

Isabel Duarte, McCann couple's lawyer, did not comment on the determination of the relationship, but merely to underscore that it is "to analyze the decision to react," admits the existence of "limited resources".

For its part, the publisher War & Peace, who edited Maddie - The Truth Lies in July 2008, announced that it "will immediately make every effort to deliver the copies seized and put the book available to the Portuguese public."

In a statement, the publisher states that the book of Gonçalo Amaral "is an important contribution to the discovery of material fact 'and considered that today's decision of higher court regarding" the right to inform and the right to review. "

The decision to cancel the prohibition of sale of the book Maddie - The Truth Lies and video with the same title, based on a documentary aired on TVI, was today notified by judicial source.

With the decision, the book and video can be re-marketed and Gonçalo Amaral, who defends the book's thesis involvement of Kate and Gerry McCann in the disappearance of her daughter in May 2007, a tourist apartment in the Algarve, you can return to speak publicly in the case.

The decision to ban the sale of the book and the video had been handed down on 14 January by Judge Cunha Rodrigues of July. Th the Lisbon Civil Court, which upheld the injunction filed by the McCanns.

The ban was provisionally decreed September 9, 2009, and the main action, the McCann family claimed the protection of the rights, freedoms and guarantees.

Madeleine McCann disappeared on May 3, 2007, in an apartment in a resort of Praia da Luz, where he was vacationing with her parents and two brothers.

This gentleman did an investigation when an employee of the state. What kind of state is that it allows data from an investigation, paid by us all serve to make a book, where profits go to the author.

Enough to force a big buck Amaral to pay compensation to the girl's parents.

This opportunistic incompetent half-bowl, owes nothing to intelligence!

It was enough to change the names in the book and announce what is real ... a "book of fiction" and would never be banned!

How on earth can a Portuguese Court do this? Amaral has stated that the McCanns killed their daughter and hid her body - this surely is slander in any countries language especially when the police have shelved the case due to 'insufficient evidence' to support this theory. I have said before, and I will say again, if the McCanns had killed Madeleine and disposed of her body, they would have come back to this country and kept quiet. They wouldn't have started a world wide campaign to search for Madeleine, and kept up the publicity at every opportunity - anyone in their right mind can see that they are absolutely devastated and will do anything to get her back. Amaral wants dealing with - and fast. Is Mrs Duarte still dealing with their case, or is there not enough funds to cover her expenses. As a matter of principle I would defend them and ask for nothing!

Don't know if you noticed a very small detail: Muleena wrote

Quote:
The Court of Appeal of Évora overturned the injunction filed by the McCann couple against the book written by the former PJ coordinator Gonçalo Amaral, the Court ordered the immediate replacement of the book at the usual sale points.

Now, it was not the court of appeal of Évora but the court of appeal of Lisbon.

BUT

The presiding judge, Francisco Bruto da Costa, has been previously assigned to the court of appeal of Évora!!!

Why this gaffe from Joana Morais?
